The article, which can be viewed here, highlights the increasing urgency among claimants to locate and attach Russian assets, as well as the practical and strategic challenges of pursuing recovery in the current geopolitical environment.
Anastasia Davis Bondarenko’s contribution focuses on two key points. First, the assumption that all viable assets have already been frozen is not borne out in practice —recent developments, including seizures in France, demonstrate that new enforcement opportunities continue to emerge. Second, effective enforcement against a state requires more than asset identification; it requires identifying and targeting meaningful pressure points capable of driving a settlement decision.
In practice, this means designing enforcement strategies that not only secure assets, but also make delay or non-payment increasingly unsustainable from a reputational, commercial or political perspective.
